Welcome to FlyCalm. By accessing our website at calm.flights or booking any of our services, you agree to be bound by these Terms of Service. Please read them carefully before using our platform or scheduling a consultation. If you do not agree with any part of these terms, you should not use our services.
1. Nature of Services
FlyCalm provides educational consultations about aviation and flying conducted by experienced airline pilots. Our sessions are designed to help individuals understand the mechanics of flight, aircraft systems, weather phenomena, and air traffic control procedures, with the goal of reducing anxiety through knowledge and understanding.
Important Disclaimer: FlyCalm consultations are NOT therapy, medical treatment, counseling, or mental health services of any kind. Our instructors are professional airline pilots, not licensed therapists, psychologists, psychiatrists, or medical practitioners. Our sessions do not constitute a patient-provider relationship. If you are experiencing severe anxiety, panic disorder, or any mental health condition, we strongly encourage you to seek assistance from a qualified mental health professional. FlyCalm is not a substitute for professional medical or psychological care.
We offer three service tiers: SkyEase Pre-Flight Brief (15 minutes via Zoom, $50), SkyCalm Session (1 hour via Zoom, $200), and FlyCalm Experience (2 hours in-person in New York City, $380). Pricing is subject to change and the current price displayed at the time of booking is the price you will be charged.
2. Eligibility
You must be at least 18 years of age to book and participate in FlyCalm consultations independently. Individuals under 18 may participate only with the express consent of a parent or legal guardian, who must complete the booking on their behalf and accept these Terms of Service. By booking a session, you represent and warrant that you meet these eligibility requirements.
3. Booking and Payment
All bookings must be paid in full at the time of scheduling. Payment details are as follows:
- All payments are processed securely through Stripe, a PCI-compliant payment processor. FlyCalm does not store your credit card information on our servers.
- All prices are listed and charged in United States Dollars (USD).
- Full payment is required at the time of booking to confirm your appointment. Your session is not reserved until payment has been successfully processed.
- You will receive a booking confirmation via email once your payment has been processed and your appointment has been created.
4. Cancellation and Refund Policy
We understand that plans change. Our cancellation and refund policy is as follows:
- Cancellations made 24 or more hours before the scheduled appointment: You will receive a full refund to your original payment method. Refunds are typically processed within 5-10 business days.
- Cancellations made less than 24 hours before the scheduled appointment: No refund will be issued.
- No-shows: If you fail to appear for your scheduled session without prior notice, no refund will be issued.
- Rescheduling: You may reschedule your appointment free of charge provided the request is made at least 24 hours before your originally scheduled session. Rescheduling requests made within 24 hours of the appointment are treated as late cancellations and are not eligible for a refund.
- FlyCalm-initiated cancellations: In the rare event that FlyCalm must cancel a session due to instructor unavailability or other circumstances, you will receive a full refund or the option to reschedule at no additional cost.
5. Session Requirements
For video consultations (SkyEase and SkyCalm via Zoom):
- A stable internet connection is required
- A working camera and microphone are recommended for the best experience
- A quiet, private environment is suggested
- You are responsible for ensuring your device and software are compatible with Zoom. A Zoom link will be provided in your booking confirmation email.
For in-person sessions (FlyCalm Experience in New York City):
- You must arrive at the designated NYC location at the scheduled time
- A valid government-issued photo ID may be required for entry
- Late arrivals may result in a shortened session; the session will not be extended beyond its originally scheduled end time
6. User Conduct
By participating in a FlyCalm consultation, you agree to conduct yourself in a respectful and professional manner. We reserve the right to terminate a session immediately, without refund, if a participant engages in abusive, threatening, or disruptive behavior toward any instructor or staff member. Recording of sessions (audio, video, or screen capture) is strictly prohibited without the express written permission of FlyCalm and the instructor.
7. Intellectual Property
All content, materials, presentations, documents, and information provided during FlyCalm consultations and on the FlyCalm website are the exclusive property of FlyCalm and are protected by applicable intellectual property laws. This includes but is not limited to text, graphics, logos, images, educational materials, and session content. You may not record, reproduce, distribute, modify, or create derivative works from any FlyCalm materials without prior written permission.
8. Limitation of Liability
FlyCalm and its instructors, employees, and affiliates shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our services. Our consultations are educational in nature and do not guarantee any specific outcomes regarding fear reduction, anxiety management, or any changes in your willingness or ability to fly. Any decisions you make regarding air travel are made at your own risk and discretion. In no event shall FlyCalm's total liability exceed the amount you paid for the specific session giving rise to the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless FlyCalm, its instructors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of our services, your violation of these Terms of Service, or your violation of any rights of a third party.
10. Disclaimer of Warranties
FlyCalm services are provided on an "as-is" and "as-available" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, FlyCalm disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will meet your specific expectations, that sessions will be uninterrupted or error-free, or that any particular outcome will result from your participation.
11. Governing Law
These Terms of Service and any disputes arising from or related to them shall be governed by and construed in accordance with the laws of the State of New York, United States of America, without regard to its conflict of law provisions.
12. Dispute Resolution
In the event of any dispute arising out of or relating to these Terms of Service or your use of FlyCalm services, the parties agree to first attempt to resolve the matter through good faith negotiation. Either party may initiate this process by sending written notice to the other party describing the dispute. The parties shall have thirty (30) days from receipt of such notice to reach a resolution. If the dispute cannot be resolved through negotiation within that period, it shall be submitted to binding arbitration administered in New York, New York, in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding, and judgment upon the award may be entered in any court of competent jurisdiction.
13. Modifications to Terms
FlyCalm reserves the right to modify or update these Terms of Service at any time at our sole discretion. Changes will be posted on this page with an updated "Last updated" date. Your continued use of our services after any modifications constitutes your acceptance of the revised terms. We encourage you to review this page periodically to stay informed of any changes.
14. Severability
If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions, which shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
